Purchases of our charm accessories, including items offered through our Cute Charms, Trendy Charms, and Lucky Charms collections, may also be subject to a separate Sales Agreement.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Skruacioa INC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND LOGISTICS PARTNERS SHALL NOT BE RESPONSIBLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM: (A) INTERRUPTION OR UNAVAILABILITY OF THE SITE; (B) THE PURCHASE OR USE OF CHARM ACCESSORIES; (C) SECURITY EVENTS OUTSIDE OUR REASONABLE CONTROL; OR (D) FAILURES OF NETWORK, COMMUNICATION, OR TRANSMISSION SYSTEMS.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR RESTRICT LIABILITY WHERE SUCH EXCLUSION OR RESTRICTION IS PROHIBITED BY APPLICABLE LAW.

8. Indemnification

To the extent allowed by applicable law, you agree to indemnify and hold Skruacioa INC harmless against third-party claims, liabilities, losses, penalties, and reasonable legal costs resulting directly from your material violation of these Terms, unlawful or fraudulent conduct, or infringement of the intellectual property rights of another person or entity.

The transfer of ownership and risk of loss for charm accessories purchased through the Site will be determined according to the applicable delivery terms, shipping arrangements, and mandatory consumer protection laws relevant to the transaction.

13. Governing Law and Dispute Resolution

These Terms of Use and related retail transactions shall be interpreted and governed according to the laws applicable to Skruacioa INC and its operation of the Oceahade storefront, without restricting mandatory consumer rights available to customers under the laws of their respective jurisdictions.

Disputes connected with access to or use of the Oceahade Site shall be addressed in accordance with applicable law and any legally enforceable dispute resolution provisions governing the relevant transaction.
